A terrorist threat is a felony offense that involves threatening to commit an act of violence that could endanger others, with a reckless disregard for the harm it would cause. For example, joking about having a gun or bomb on an airplane could be considered a terrorist threat.
In California, terrorist threats are now called "criminal threats" and are outlined in Penal Code Section 422. The prosecuting attorney's office can charge the crime as either a misdemeanor or a felony, depending on how serious they believe the crime is. A misdemeanor conviction can result in up to one year in jail and/or up to $1,000. A felony conviction can result in 16 months, 2 years, or 3 years in prison, plus one year if a dangerous weapon was involved, and/or up to $10,000. A felony conviction also counts as a "Strike" under California's "Three-Strikes Law". A second felony conviction doubles the sentence, and a third felony can result in 25 years to life in prison.
